Mumbai: Sanjeev Palande, the then private secretary of former Maharashtra home minister Anil Deshmukh, told the special court through his counsel on Monday that the Enforcement Directorate had served him without permission to reply to the notices issued to him. Arrested in money laundering case.
Palande, an additional collector rank officer, was arrested by the Enforcement Directorate (ED) on June 26 in a money laundering case involving Deshmukh. Palande is currently in judicial custody. He has recently filed an application for bail.
Advocate Shekhar Jagtap, appearing for Palande, told the court on Monday that Palande was taken into custody on the same day his house was raided. Jagtap argued that the ED arrested Palande without allowing him to reply to the notice issued to him.
Notice issued under section 41A
He said that the ED had raided the residence of Palande on the same day of action in Deshmukh’s house and offices. Jagtap said, “Both Palande and Deshmukh were served notices under Section 41A of the Code of Criminal Procedure, but Palande was not given an opportunity to respond to the notices and was arrested.”

Kundan Shinde, another accused arrested in the case, has also filed a bail application. Kundan was working as Deshmukh’s assistant (PA). Shinde’s lawyer Ejaz Khan argued that his client has been convicted in the case on the basis of the statement given by sacked Mumbai Police officer Sachin Waje.
Khan argued that Waje’s statement cannot be relied upon as his genuineness is under question. Waje is an accused and behind bars in another case. The court will now hear the bail applications on September 29.
